New Personnel Records Law is signed by the Governor in New York

New York's Personnel Records Law will go into effect
on November 8, 2026. The most important parts of this new law entitle employees to copies of their personnel files upon request. The personnel files must include, if they exist, the job application, resume, performance evaluations, written warnings concerning substandard performance, documents relating to probationary periods, waivers signed by the employee signed, termination notices, and records of disciplinary actions.
Employers will also be required to notify employees if there is anything placed in the employee's personnel file that could negatively affect the employee's opportunities for promotion, transfer, or compensation (including raises), or that may result in disciplinary action.
It is expected that the new law will be enforced by the attorney general's office. Employees may not be retaliated against for exercising rights under the Personnel Records Law.
